HB 2102 SummarySponsor: Representative Dave Winters (R-69, Rockford)
Amends the Mobile Home Local Services Tax Act. Raises the tax rate applied to each model year category. Note: One of the lines in the act originally raised the tax from 15 cents to 75 cents per square foot.

Creates the Adult Uses Location Restriction Act to provide restrictions on the proximity of adult entertainment establishments to other adult entertainment establishments, school, parks, places of worship, pre-schools, day care facilities, manufactured home communities, or other residential areas. Provides that a violation of this Act is a separate petty offense for each day of violation.
This bill is currently assigned to the Judiciary Committee where it is scheduled for a hearing on March 20. MHOAI will attend the hearing.

At the time of this newsletter the bill has not been fully completed. MHOAI and Senator Radogno have met with representatives of the Illinois Attorney Generals office. This bill allows the Attorney General to help enforce our laws, and also updates current laws. MHOAI will keep you informed as we continue working on this bill.

Note: This is a continuation of HB 3928 which was presented last session. Portions of HB 3928 were taken from the original SB 70.
History: Last year this bill passed the Senate and House and was expected to be finalized during the veto session by the House of Representatives. Instead, it was the only bill not called. We're not sure why the bill died since everyone has their own theories. Members of the House of Representatives, representatives from the landlord's association and others all voiced support for the bill. Despite this verbal support and assurances from your legislators, for the 12th year in a row, all manufactured home owners bills have died in the House. This bill would have been compatible with newly passed federal legislation regarding manufactured homes. Now representatives from the landlord's association and others have proposed changes in the modified HB 3928 which had already been subject to numerous compromises. The latest proposals include removing the Quality Assurance Board and placing it under the appointment and supervision of the Governor. In our opinion, we should be allowed to choose our own representatives to the Board and the board should work under the auspices of the Illinois Department of Public Health since that office is already involved in many of our issues. According to procedure, the bill was again placed in a committee for eventual recommendation to the full House of Representatives. This is what happened to HB 3928, except it was placed in Executive Committee where it died under the discretion of the House leadership. We initially believed home owners might have a chance with the revised HB 681 when it was initially placed in the Rules and Regulations committee where it belonged and where we could work with the legislators to better represent you, the home owners. However, the bill was immediately removed and again placed in the Executive Committee where all of our bills have withered and died over the past 12 years. What will it take to establish and enforce state-wide standards? What will it take to get basic protections out of the Executive Committee and signed by the Governor: You.
