Amends the Mobile Home Landlord and Tenant Rights Act to create the Mobile Home Park Ombudsman. Provides that the Ombudsman is appointed by the Director of Public Health and shall be an employee of the Department of Public Health. Provides that the Ombudsman shall receive and investigate complaints related to the Act and report violations of the Act to the Attorney General for enforcement. Creates the Mobile Home Park Owner's and Tenant Advisory Board to consult and advise the Department of Public Health. Amends the Mobile Home Park Act to require an application fee for a mobile home park license of $100 plus $5 for each mobile home space in the park (currently, $100 and $3 for each space). Provides for a $5 license fee for each space added to a mobile home park after original issuance of the license (currently, $6 for each spaced added later). Provides that funds received from license fees for mobile home parks shall be deposited in the Facility Licensing Fund (instead of the State Treasury). Effective immediately.

A BILL FOR
AN ACT concerning mobile home parks.
Be it enacted by the People of the State of Illinois, represented in the General Assembly:
Section 5. The Mobile Home Park Act is amended by changing Section 6 as follows:

Sec. 6. In addition to the application fees provided for herein, the licensee shall pay to the Department on or before March 31 of each year, an annual license fee which shall be $100 plus $5 $3 for each mobile home space in the park. Annual license fees submitted after April 30 shall be subject to a $50 late fee. The licensee shall also complete and return a license renewal application by March 31 of each year.
The licensee shall pay to the Department within 30 days of receipt of notification from the Department $5 $6 for each additional mobile home site added to his park under authority of a written permit to alter the park as provided in Section 4.2 of this Act, payment for the additional mobile home sites to be made and an amended license therefor obtained before any mobile homes are accommodated on the additional home spaces. The Department shall issue an amended license to cover such additional mobile home sites, when they are to be occupied before the end of the license year, for which an annual license has been previously issued.
Subsequent to the effective date of this Act, an applicant for an original license to operate a new park constructed under a permit issued by the Department shall only be required to pay 1/4 of the annual fee if such park begins operation after the 31st day of January and before the 1st day of May of such licensing year; or 1/2 of the annual fee if such park begins operation after the 31st day of October and before the 1st day of February of such licensing year or 3/4 of the annual fee if such park begins operation after the 31st day of July and before the 1st day of November of such licensing year; but shall be required to pay entire annual fee if such park begins operation after 30th day of April and before the 1st day of August of licensing year.
Each license fee shall be paid to the Department and license fee or any part thereof, once paid to and accepted by the Department shall not be refunded
The Department shall deposit all funds received this Act in the Facility Licensing Fund State Treasury

Section 10. The Mobile Home Landlord and Tenant rights Act is amended by adding Sections 27 and 28 as follows:

Sec. 27. Mobile Home Park Ombudsman.
(a) There is created the Mobile Home Park Ombudsman, hereinafter referred to as the Ombudsman. The Ombudsman shall be appointed by the Director of Public Health and shall be an employee of the Department of Public Health.
(b) The ombudsman shall serve as a liaison between the State, mobile home park owners, and tenants of mobile homes and shall protect the rights and interests of mobile home tenants and mobile home park owners. The Ombudsman shall receive and investigate complaints related to this Act for the Purpose of obtaining non-binding resolution of conflicts between park owners and tenants related to this Act. The Ombudsman may seek the advice of individuals possessing specific expertise or members of the Mobile Home Park Owners' and Tenants' Advisory Board.

(c) The Ombudsman shall refer violations of this Act to the Attorney General for enforcement activity.

Sec. 28. Mobile Home Park Owner's and Tenant's Advisory Board.
(a) There is created a Mobile Home Park Owner's and Tenant's Advisory Board to consult and advise the Department of Public Health. The Board shall be comprised of the Ombudsman who shall serve as Chairman ex officio and 10 members as follows: 2 residents of mobile home parks who have lived in mobile homes for at least 5 years; the president of a state association of mobile home owners or his or her representative; 3 individuals who have owned a mobile home park of at least 20 sites for at least 5 years; a representative of the Cook County Department of Public Health; a building official familiar with the installation of mobile homes; a representative of the American Association of Retired People; and a representative of the Statewide Housing Action Coalition.
(b) Members of the Board shall be appointed by the Ombudsman for 3 year terms, except that, of the initial members, the terms of 3 members shall expire December 31, 2001 and the term of 3 other members shall expire December 31, 2002. Members shall serve until their successors are appointed and qualified. Any member appointed to fill a vacancy occurring prior to the expiration of the term for which his predecessor was appointed shall be appointed for the remainder of that term. The initial appointments shall commence January 1, 2000
(c) The Board shall meet at least 3 times each year. Additional meetings may be called by 3 members of the Board upon delivery of a written notice to the Ombudsman. A majority of the members of the Board shall constitute a quorum. Each member of the Board shall be compensated for travel expenses incurred in the performance of duties as a member of the Board in accordance with the Rules of the Travel Regulation Council in the Illinois Administrative Code.
Section 99. Effective date. This Act takes effect upon becoming law.
