We have our work cut out once again with legislation that keeps coming back every year in a different form by a landlord association. This is the same type of legislation we stopped during the veto session discussed in our November publication. However, while it is very bad legislation many agreed it did look prettier this time around. In fact Senator Clayborne took language out of SB 320 and added it.
Realistically it would not be much of a help because this bill preempts home rule and would allow for all sites at the signing of this law to be considered existing lots and any new rules, regulations or future laws would not be able to be enforced on existing lots. In other words if a lot was established in 1960, new standards in place would never apply. While this did pass the committee, it was noted the amount of opponents which included MHOAI, Cook County Department of Public Health, Illinois Department of Public Health, Illinois Municipal League, firefighter related organizations and others who opposed this type of legislation now and in past years.
